Musikhaus City Sound - Terms & Conditions

§ 1 Terms of Use

Musikhaus City Sound GbR and its affiliates provide their services to you subject to the following conditions. If you visit or shop at Musikhaus City Sound, you accept these conditions.

§ 2 Contract and availability

No contract will subsist between you and Musikhaus City Sound for the sale by it to you of any product unless and until Musikhaus City Sound accepts your order by e-mail. Your order represents an offer to us to purchase a product which is accepted by us when we send e-mail confirmation to you that we've dispatched that product to you. Any products on the same order which we have not confirmed in a Dispatch Confirmation E-mail to have been dispatched do not form part of that contract.
In the unlikely event that an item is not available after a contract has been accepted, we reserve the right to withdraw the contract and payments made by the customer will be redeemed.

§ 3 Shipping

Unless otherwise agreed, shipping will be handled by a freight forwarding company. We will deliver to the shipping address supplied by the customer. Goods are to be inspected by the customer at the point of delivery. If goods have been damaged in transit you need to get written confirmation from the carrier and contact us in writing immediately. Please note that delivery times are estimates. They are not guaranteed delivery times and should not be relied upon as such. No claims can be made if items are not delivered within the estimated delivery time unless it was an act of gross negligence.

§ 4 Payment options

You can choose from the following payment options: Cash payment (collection of goods by the customer) / advance payment / cash on delivery / on-line payment. All prices are in Euro are inclusive of VAT. Shipping and wrapping costs are listed separately.

§ 5 Returns Policy

You can cancel an order within two weeks after you have received the articles. We will e-mail you our returns policies together with the order confirmation. All relevant laws and regulations will be found in the e-mail disclaimer (see EU rights of contractual withdrawal"). The period begins with receipt of that disclaimer and the goods.
Goods that have been manufactured according to a customer's specification cannot be returned. Copyrighted materials cannot be returned once opened due to copyright law. This includes books, videotapes, DVDs, sample libraries, style disks, sound expansion boards, and software.

§ 6 Warranty

By law, customers in the European Union have the right to receive a replacement or free repair service if yo have received faulty goods. The warranty period is 2 years from receipt of the goods. We offer warranty for all goods that are defective due to faulty materials or manufacturing defect.

The following products are excluded from our warranty services:

natural wear and tear,
improper use of a product,
goods that are damaged through use of unsuitable accessories or replacement parts that are not part of the original product.
Products that were modified by the customer

The warranty period will not be extended or newly activated when submitting a warranty claim.

§ 7 Ownership

All delivered goods remain the property of Musikhaus City Sound until full payment has been received.

§ 8 Place of jurisdiction and fulfilment

All legal disputes fall under the laws of the Federal Republic of Germany. Leipzig, our address of record will be place of jurisdiction as well as place of fulfilment.

§ 9 Final clause

If a particular contractual clause becomes invalid or inexecutable it does not affect the validity of the rest of the contract.t.
